Take Down Notices

The introduction of the Copyright Amendments Act 2004 (No 1) effective from 1 January 2005 has changed the way Internet Service Providers (ISPs) in Australia deal with allegations of piracy on the Internet. All ISPs are bound by this law and it is important you understand its implications.

If The University of Queensland (UQ) receives a notice, if we do not want to be liable for infringement of material residing on our network at your direction, then we are required by law to act expeditiously to remove or disable access to this material.

If we receive a take down notice, specifying your account then in line with its policy, UQ will act to remove the alleged infringing material from its network or, where this is not technologically possible, we will disable your access to the material by suspending your use of your account. If this happens, then the procedure will be that set out in the Copyright Amendment Regulations 2004 (No.1).

Generally, in order to protect yourself from a potential take down notice, please be aware of the following:

  • Do not use pirated software.
  • Be careful about who uses your account. If you live in a share-house and your room-mate uses your connection, you are responsible for their actions.
  • Know what your children are doing. Children, in particular, use the Internet in a variety of ways and as the Account holder, UQ holds you responsible for the way in which your internet access is used.
